    El Trumpo quietly ran away from his promise to pursue the first EO to the SC, but dadgummit he's still gonna ban him some mooslims

    Dropped Iraq from the naughty list, abandoned the language about favouring minority religions, aka christians, stops trying to fuck with green card holders, refugees already approved or anyone with dual nationality, and pinky swears that this time it's not even a little bit aimed at muslims. He also signed it in private this time and has given a ten day window for bad hombres to rush in before implementation, plus added some language about the retroactive excuses they've come up with for why those 6 countries.

    So, back to court we go. It's been specifically drafted to try and get round the legal challenges to the last one, but it still lacks rational basis and will be subject to challenges based on the statute that grants him the power, and on the constitutional problems with trying to ban muslims.

    It seems the only demonstrable effect of this order is to lend credibility to Brannon and Trump's reputation as useless bigots.

      Some differences between the last order
      1. Iraq is dropped from the list of countries
      2. Syrian refugees are not blocked indefinitely like they were in the previous order (refugee cap is still going be dropped from 110k to 50k though)
      3. People with green cards and current visa holders are exempt from this travel ban.
      4. Clearer language regarding giving priority to religious minorities that are persecuted.

      Original Text about religious minorities:
      Upon the resumption of USRAP admissions, the Secretary of State, in consultation with the Secretary of Homeland Security, is further directed to make changes, to the extent permitted by law, to prioritize refugee claims made by individuals on the basis of religious-based persecution, provided that the religion of the individual is a minority religion in the individual's country of nationality. Where necessary and appropriate, the Secretaries of State and Homeland Security shall recommend legislation to the President that would assist with such prioritization.


      Revised order text about religious minorities:
      Executive Order 13769 did not provide a basis for discriminating for or against members of any particular religion. While that order allowed for prioritization of refugee claims from members of persecuted religious minority groups, that priority applied to refugees from every nation, including those in which Islam is a minority religion, and it applied to minority sects within a religion. That order was not motivated by animus toward any religion, but was instead intended to protect the ability of religious minorities -- whoever they are and wherever they reside -to avail themselves of the USRAP in light of their particular challenges and circumstances.

        Whenever they attempt to explain why those particular countries provide a "unique threat" to the US is where the logic always falls apart. Just another ineffective farce of an order that is meant to be red meat for the muslim haters under the guise of keeping us safer.

              There's little question that the SC, restored to the proper 5-4 balance, will bitchslap the liberal 9th Circus Court, and reassert the Executive authority in contention.

                  More likely because he'll rule on the law and not on his feelings. Or on what he may feel the law should be.

                    If SCOTUS gave a split decision on this order it would not invalidate the EO, a small victory for Trump, and sign of support from conservative legal minds on the ban. He's not going to SCOTUS cause he knows it would lose, probably unanimously. I'm not even hopeful about this rewrite.

                        I think there is serious question as to whether the Court would overturn the 9th court.

                          Angry tweets a' comin'.

                          I suspect the new order would pass constitutional muster if viewed in isolation, but there's the rub, it's being viewed in the context of the endless derps and the first ban. On the plus side, El Trumpo has had 50 days and the ban to 'figure out what is going on' would only have been for 90, so his tip top efficient administration is probably nearly there with the new and improved vetting procedures.
